It's a sad story regardless of how one perceives it; one man is dead, another injuried, and the life and liberty of a young post-military man hangs in the hands of a Dane County jury.

But in the world of criminal defense, where a conviction for First Degree Intentional Homicide would mean a mandatory lifetime prison sentence, this story ended with a silver lining according to Madison WI criminal defense lawyer, Christopher T. Van Wagner.

Perry Lucas was charged with First Degree Intentional Homicide and First-degree reckless endangerment in the shooting of two brothers. Detarius Martin was killed during the incident.

Lucas was initially represented by Attorney Dennis Ryan of Wisconsin, who upon reading a military psychological profile on Lucas, entered an insanity plea.

Dane County Assistant District Attorney Tim Verhoff prosecuted the case, arguing that Lucas basically gunned down an innocent unarmed man.

Lucas' lawyer, Attorney Jessa Nicholson, painted a different picture. She opened her arguments at trial with a dramatic flare, something expected - or at least not out of question - with Attorney Chris Van Wagner (reknown for his creative defense strategies, such as the 6-second close in a winning sexual assault case).

The Dane County jury acquitted Lucas of the charge of 1st Degree Intentional Homicide (see definition of 1st Degree Intentional Homicide under Wisconsin law).

The jury found Lucas guilty of 2nd Degree Intentional Homicide (see definition of 2nd Degree Intentional Homicide under Wisconsin Law).

While an acquittal on the charge of 1st Degree Homicide with a guilty verdict on the charge of 2nd Degree Homicide might seem to be a far cry from the acquittal in the Meng murder case (Meng was completely exonerated with an acquittal (not guilty verdict) of 1st Degree Intentional Homicide after he had admitted to the crime and hiding the body of the victim - Attorney Chris Van Wagner defended Meng), when one considers that First Degree Intentional Homicide is a Class A Felony carrying a mandatory life sentence under Wisconsin law while Second Degree Intentional Homicide is a Class B Felony carrying up to a 60 year prison sentence, Lucas' attorney (Jessa Nicholson) did well for a first-time murder defense lawyer.
